We’ve been spending some time studying what the kids are saying, so we want to try out a new phrase this week. Here we go… We’ve called our usual contacts, and it appears that there is nothing poppin’ this weekend.

Translation: There aren’t any checkpoints scheduled from what we’ve seen. As always, we’ll update the blog if we hear otherwise.

We’re hoping we used that phrase right, but we have our doubts. That’s all for now. We’ll see you next week.

So far this week we have one checkpoint to report. It seems that Clark County will be having a checkpoint tonight. The date and time of this checkpoint has not yet been released, but when we hear more we’ll post it as soon as possible.

Other than that, we have no word about checkpoints in Ohio this weekend. We’ll update you if we have more.

Sometimes.

It was true for R.E.M., and today it’s true for the Ohio OVI Blog. Why? Because we were given information about a checkpoint in Brunswick for this weekend that wasn’t accurate. It came from a trusted news source, but the nice officers in Brunswick informed us it wasn’t true.

They will still, however, be running saturation patrols for the big game this weekend. So our advice, as always, is live safe by driving sober.

We’ll keep calling other law enforcement offices in Ohio to see if there are other checkpoints this weekend. We’ll update you as we know more.

Not surprisingly, the number of local Super Bowl parties draws the attention of the police. Brunswick Police have already announced that they will be keeping an extra eye out for drunk drivers before, during and after the game.

The breathalyzer test in Ohio: Knowing your rights http://www.ohiooviblog.com/the-breathalyzer-test-in-ohio-knowing-your-rights/ http://www.ohiooviblog.com/the-breathalyzer-test-in-ohio-knowing-your-rights/#comments Tue, 10 Jan 2012 16:34:25 +0000 Taubman Law http://www.ohiooviblog.com/?p=33 In Ohio there are two instances where you can be given a breat test by a police officer. The first, the portable breath test, is generally administered during the initial traffic stop. Here’s what you need to know: This test is never mandatory and is not admissible in the court of law. Taking this test and failing will only lead to more evidence against you if you’re charged with OVI/DUI. There is no reason to consent to the portable DUI test.

If you fail this test, the officers will arrest you and take you back to the station to do another breath test on an approved device. Currently, there are two approved breath-testing devices in Ohio – The BAC Datamaster and the Intoxilyzer 5000. At this time you will be told you can blow or refuse. A refusal to blow at this point will be an automatic suspension of your license for a year and could have other repercussions if you have a CDL. If you choose to blow and are above the Ohio legal limit of .08, you will be charged with an OVI/DUI and booked. More importantly, if you are booked and have blown above .169 you will be charged with a Super DUI. It’s important to assess your own condition at this point.

Refusing to blow or blowing above the legal limit does not mean that you don’t have a chance to be found not guilty or have your charges reduced.

In the last year we’ve had two situations at Taubman Law where drivers have refused to take the breathalyzer at the station and another case where the driver blew above .169 in the station. We were able to work with each case and ensure the best result possible.

In first one, in Berea, the driver was pulled over for following too closely and submitted to a field sobriety test, which he failed. After a motion to suppress, we were able to get the charges knocked down to a reckless operation, our client was able to get his license back within nine months and was granted occupational driving privileges as soon as the statute allowed.

In another case,  we represented a person stopped in Vermillion for weaving and driving erratically. He failed his field sobriety tests and refused to take a breathalyzer. We were able to have his charges reduced to physical control, which carries no points and the client was allowed work privileges.

Finally, in a case where one of our clients blew above .169 and was charged with a Super DUI in Bedford, we were able to work a good plea accommodation. Charges were reduced to regular DUI and the client didn’t have to go through the embarrassment of having yellow ‘party’ plates or having an ignition lock. The client also served no days in jail and received driving privileges.

We’ll let you know if you we hear otherwise, but as of now there are no checkpoints scheduled for January 6-8. Have a safe and productive weekend. Remember to designate a driver if you’re going out to drink.

We hope you are enjoying time off with family, friends and relaxation.

The new year is coming, which means that local and state law enforcement will be out in heavy numbers over the next few nights. We know of one checkpoint thus far. Here are the details:

Cleveland will have one tomorrow night (Friday) from 7:30 pm to 2 am on East 55th.

There may be more coming, but for now all the stations we’ve called have just promised lots of saturation points.

Our recommendation, as always, is that you designate a driver before you go out and drink all your egg nog.

We wanted to share with you a release we received this week regarding saturation points around the state for Christmas and New Year’s. It seems that the state is beefing up efforts to keep everyone safe by increasing state highway patrol help in conjunction with local police.

We don’t have any news on official checkpoints right now, but here’s a portion of the release from the Ohio State Highway Patrol:
 
“As part of national holiday enforcement efforts, the Department of Public Safety’s Office of Criminal Justice Services is assisting law enforcement around the state, including OVI task forces, in coordinating efforts to step-up enforcement of traffic and impaired driving laws. Last year in Ohio, 39 people died in alcohol-related crashes between Thanksgiving and New Year’s.”
